Who is Fincasso?

We are a young dynamic debt collection agency with only 1 goal. To ensure that you get what you are entitled to. Collecting your debts safely, fairly and fast is our priority.

Why debt collection?

Unpaid invoices can put you in a financially difficult situation immediately or in the long term. It is therefore important to react quickly and appropriately. Debt collection is the appropriate procedure to avoid these undesirable financial consequences.

Why should I use Fincasso?

Fincasso takes care of you directly after you have easily uploaded your invoices. This means you don’t have to waste your precious time on your debtor. In addition, Fincasso guarantees a quick and efficient handling of your file. In other words, you have no headaches and receive your money faster.

How does Fincasso work?

1. You submit your unpaid invoice online. Free of charge. If you have other documents, you may also submit them. These are documents that you use to your advantage. For example, correspondence, general terms and conditions in your contract or a credit report. Once we have all the information, we get to work.

2. You no longer have to worry about your unpaid invoice. From the moment we receive your claim, we take over all contact with your debtor. We will also keep you informed if we receive more information ourselves.

3. Your debtor receives a reminder letter from us. This will state the unpaid invoice and set a payment deadline. This depends on the type of claim and the mandatory legal requirements.

4. After this, everything depends on the debtor’s reaction. There are two options:

Scenario 1:
Your debtor has received the reminder and complies with the payment deadline. Your invoice is collected. You therefore receive your money. Or your debtor agrees to cooperate on an instalment plan at acceptable terms.

Scenario 2:
Has your debtor still not paid? Or has there even been no response? Then we will send a second reminder letter/mail.

5. Is your debtor still not answering and/or has the invoice not been collected? Then we engage the last option. Legal proceedings. We will be happy to arrange for a lawyer from our network. He will check whether an IOS procedure is possible. Otherwise, your debtor will be summoned.

6. After the declaration of enforceability of the statement of non-disputation by a magistrate (IOS-procedure) or as soon as the judgement has been obtained, enforcement starts. The duo of lawyer and bailiff will handle the case. This service is included in your price.

How much does Fincaso cost?

Fincasso works on a ‘no cure no pay’ basis. This means that in principle you pay nothing. You receive your full unpaid invoices. Exceptionally, certain services are subject to a different fee, which can be easily consulted at “tariffs“.

The only situation in which you do pay something is when your claim is uncollectable. In that case, however, you will only pay the bailiff fees we have advanced. We always ask permission to carry out these costs.

How do I send my invoices to Fincasso?

We have chosen to do everything electronically. This means that you simply upload your invoice through our website. The big advantage is that this only takes a few minutes of your time.

How is data protected/kept by Fincasso?

Fincasso has exclusive access to the files you send us. Our IT staff ensures that both your data and that of your debtor are stored securely.

How does Fincasso avoid relationship damage with my client?

We always put ourselves in the client’s shoes to ensure a sustainable client approach. At Fincasso we think this is very important. We believe in building strong relationships.

How does the contact via Fincasso proceed?

From the moment we receive your claim, we take over all the contact with your debtor. Fincasso communicates with your debtor in an appropriate and transparent way. Experience teaches us that good communication is indispensable for a good understanding between all parties involved.

What if my debtor has already paid?

Good news! Contact us so that we can finalise the case. This also applies if you have received a partial payment.

What if my debtor wants an installment plan?

In certain cases, this offers a solution. Fincasso examines whether this is appropriate. Our experts can also approve/propose an instalment plan in consultation with you and your debtor.

What if my debtor still doesn’t respond?

Then we turn to the last option: the legal procedure. This consists of either The IOS procedure or legal proceedings.

What is the IOS procedure?

The IOS procedure is an administrative procedure for the recovery of undisputed monetary debts. The procedure is initiated by a demand for payment (served by a bailiff). This procedure only applies to B2B relations. The advantage of the IOS procedure is that an enforceable title can be obtained without having to go through the courts. This therefore saves you time and money.

What if the debtor ignores the payment demand?
The debtor has a period of one month to react. If he does not, it is assumed that he does not dispute the debt. The procedure will therefore continue. Specifically, eight days after this period, the bailiff will draw up an official report of non-contestation. If the report is declared enforceable by a magistrate, it can be used to start the enforced recovery procedure.

What if the debtor contests the payment demand?
The debtor must then state the reasons for challenging it within a period of one month. The motivated contestation stops the IOS procedure. As a result, the creditor can only recover the debt through the conventional courts.

What happens if I summon my debtor?

A summons means that you officially inform your debtor that you are applying to the court to have the claim forcibly collected. The legal proceedings are thus initiated.
